Terms of Use
Face Seek: AI Face Search, operated by Baan Software. These Terms are also the end user licence agreement (EULA) for the App.
1. Agreement
These Terms of Use form a binding agreement between you and Baan Software (“we”, “us”). By downloading or using Face Seek (“the App”), you accept these Terms. If you do not accept them, do not use the App.
You must be 18 or older to use Face Seek.
2. What Face Seek does, and what it does not do
Face Seek runs a reverse image search across publicly indexed images on the open web and returns pages where visually similar faces appear.
Face Seek does not:
- Access government, law enforcement, or private identity databases
- Verify anyone's identity
- Confirm that a match is the same person
- Provide a consumer report of any kind
Results are probabilistic and may be wrong. A high similarity score is not proof of identity. You must not treat Face Seek output as fact, and you must not rely on it to make decisions about any person.
2.1 Prohibited uses under consumer reporting law
You may not use Face Seek, in whole or in part, to make or influence a decision regarding:
- employment, hiring, promotion, retention, or reassignment
- housing, tenancy, or lodging
- credit, lending, or insurance
- educational admission or eligibility
- any other purpose regulated by the Fair Credit Reporting Act or an equivalent law in your jurisdiction
We are not a consumer reporting agency and Face Seek is not a consumer report.
3. Your responsibilities
By submitting a photo you represent that:
- You own the photo, or you have permission to use it
- You have a lawful basis to submit the image of any person appearing in it
- The photo does not depict a minor
- Your use complies with all laws that apply to you, including biometric privacy laws
You are solely responsible for your searches and for what you do with the results. See our Acceptable Use Policy, which is incorporated into these Terms.
4. Subscriptions and payments
Face Seek offers a limited number of free searches. Additional searches and unlocking result links require a purchase.

Prices may change. We will give notice before any change takes effect, and a change never applies to a period you have already paid for.
5. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, in accordance with the usage rules of the store you obtained it from.
You may not:
- Copy, modify, decompile, reverse engineer, or create derivative works from the App
- Scrape, automate, or bulk-query the service
- Rent, lease, resell, or sublicence access
- Circumvent rate limits, paywalls, or security measures
- Use the App to build a competing product or dataset
6. Content and intellectual property
The App, its design, and its underlying technology belong to Baan Software. Search results link to third-party web pages that we do not own or control and are not responsible for.
You keep ownership of the photos you submit. You grant us a limited licence to process those photos solely to perform the search you requested, for the duration described in our Privacy Policy.
7. Availability
We aim to keep Face Seek available, but we do not guarantee uninterrupted service. Searches are subject to capacity limits and may be temporarily refused. We may modify, suspend, or discontinue features at any time. If we discontinue a paid feature you have already paid for, we will provide a pro-rated remedy through the store you purchased from.
8. Termination
We may suspend or terminate your access if you breach these Terms or the Acceptable Use Policy, or if your use creates legal risk for us or harm to another person. You may stop using the App at any time. Face Seek does not create an account; to have the data associated with your install deleted, follow Delete My Data.
9. Disclaimers
The App is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We make no warranty that search results are accurate, complete, current, or that any match corresponds to a particular individual.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.
Our total aggregate liability arising out of or relating to the App is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or US$100.
Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
11. Indemnity
You agree to indemnify and hold us harmless from any claim arising out of your use of the App, your submission of photos, your breach of these Terms, or your violation of the rights of any third party.
12. Third party services
The App relies on third-party services to function, including our image search provider and our payments provider. When you use the App you must also comply with any applicable third-party terms of agreement that govern those services.
13. Apple-specific terms
This section applies to the App obtained from the Apple App Store, and prevails over any conflicting provision elsewhere in these Terms for that copy of the App.
- Acknowledgement. You and we acknowledge that these Terms are concluded between you and us only, and not with Apple. We alone, not Apple, are responsible for the App and its content.
- Scope of licence. The licence granted in section 5 is a non-transferable licence to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support. We are solely responsible for providing maintenance and support for the App, as described in these Terms or as required by law. Apple has no obligation whatsoever to furnish any maintenance and support services for the App.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of frameworks that process health, fitness or biometric data.
- Intellectual property rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.
- Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and address. Questions, complaints or claims with respect to the App should be directed to Baan Software at faceseek@baansoftware.com.
- Third party terms of agreement. You must comply with applicable third party terms of agreement when using the App.
- Third party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third party beneficiary of them.
14. Google Play
For the App obtained from Google Play, these Terms are between you and us only, and not with Google. Google is not responsible for the App or its content, and purchases are governed by the Google Play Terms of Service. Refunds for purchases made through Google Play are handled by Google.
15. Governing law and disputes
These Terms are governed by the laws of Singapore, without regard to conflict of law rules. Disputes will be resolved in the courts of Singapore.
If you are a consumer resident in the EEA or the UK, this does not deprive you of the protection of mandatory consumer law in your country of residence, and you may bring proceedings there.
16. Changes
We may update these Terms. Material changes will be notified in the App at least 14 days before they take effect. Continued use after that date means you accept the updated Terms.
